To support its continued growth, Breathe is looking to recruit a Commercial Manager. We are moving into the build phase on a number of £multi-million projects and this Commercial Manager will be responsible for the development and implementation of our Commercial strategy, with sub-contract/supplier spend in excess of £15m, alongside other procurement activities.

About the role:

  • Develop and implement a commercial contract strategy covering tendering, contractor selection and ongoing performance management across Breathe’s entire project portfolio.
  • Provide bid support including contract reviews, commercial and pricing inputs and bid writing as required.
  • Work closely with the Senior Commercial Manager and Breathe’s operational management teams to maximise commercial understanding, efficiency, and opportunities across our business.
  • Work with the Senior Commercial Manager in the development of Group commercial process and initiatives.
  • Managing and working with our external and internal legal counsel for best commercial and legal practice.
  • Responsible for commercial due diligence in pre-sales activity, managing contract execution and governance (internal and external) of handover of contracts into construction.
  • Lead contract handover to construction –supporting the QS throughout the design and build phases on contractual matters up to final account agreements with our supply chain
  • Ensuring sub-contracts align with Breathes client contracts and carry the right balance of risk and reward.
  • Support the projects by promoting commercial awareness to develop consistent standards across the business.
  • Assist the business in achieving the target Gross Margin on each allocated project.
  • Provide ongoing commercial support across the business, including the provision of a contract suite that support the business model and provides and efficient, but low risk route to contracting with new and existing clients.
  • Support all the relevant project teams to close down contracts – minimising post contract liability exposure. Logging and storing.

 

About You:

  • A proven track record in commercial roles and demonstrable success in developing, implementing and managing commercial processes that can be shown to have delivered value.
  • A strong understanding of construction contract terms and conditions, preferably NEC (4) and JCT, as well as the ability to compile full contractual document packs for execution ensuring internal processes are followed with a keen eye for detail
  • An in-depth experience in developing and executing energy performance contracts with both clients and suppliers. Knowledge of energy performance frameworks including; Refit, Essentia, Strategic Energy Asset Management  (SEAM) and the Carbon Energy Fund would be advantageous.
  • Demonstrate ability to negotiate and close contracts within the parameters of the business-critical parameters, with a high working knowledge of key contractual provisions, performance conditions, typical clauses /mitigations
  • A strong ability to work under pressure in closing commercial matters with a proven track record of dispute resolution and mediation skills
  • Ability to standardise internal approach across functions to reduce closure time for opportunities and advance the deal cycle from detailed design to construction
  • Adherence to commercial contract best practice, ethical standards, laws and regulations
  • Ability to drive internal and external decision making timelines
  • The ability to influence colleagues, stakeholders and suppliers drawing on a range of skills and negotiation techniques.

 

Skills & Experience:

  • 8+ years experience of working within a Commercial environment in Energy, Construction, Engineering, SME business
  • Exposure to Mechanical and electrical engineering, architecture, civil engineering, general construction or similar projects
  • Experience using spreadsheet-based tracking tools and a SharePoint server. Experience of NAV system or other salesforce type systems
  • Experience producing reports for internal use and external presentation
  • Expert knowledge of Microsoft (expert in Excel) is essential and ideally Navision Database
  • Ability to travel to Breathe offices in the UK (London & Leeds) also project site visits as and when required.
